A New York divorce attorney can guide you through the initial filing process. The first thing that needs to be done is the drafting and filing of a Summons with Notice, or a Summons with Complaint. The Summons is a specific written legal form that puts the defendant/spouse on notice that a divorce has been commenced, and that they must answer in either 20 or 30 days depending on how it was served. 20 days if the documents were delivered personally, and 30 days if they were through some other method. The notice provides the defendant with a little background on the plaintiffs request for a divorce and other relief. The complaint on the other hand is the initial pleading in a divorce matter.
