After spending the beginning of his legal career representing large and small businesses in complex commercial litigation, Ross has focused his practice on helping consumers and victims of corporate wrongdoing. Currently, Ross serves as lead counsel, co-lead counsel or on the executive committee in several class actions pending in federal and state court in cases involving consumer fraud, product defects, food mislabeling, false advertising, and other state and federal consumer protection laws. Ross has also successfully litigated numerous individual and class action cases involving violations of the Telephone Consumer Protection Act.
Mr. Schmierer’s notable cases include:
McKinney, et al. v. HSBC Bank (S.D. Illinois) where Mr. Schmierer served as co-lead counsel in challenging HSBC’s imposition of charges for so-called “payment protection” or “credit protection” programs resulting in a $23.5 million settlement for cardholders.
In Re: Bank of America Credit Protection Marketing & Sales Practices Litigation, (N.D. California.) where Mr. Schmierer served on the executive committee in challenging BOA’s imposition of charges for so-called “payment protection” or “credit protection” programs resulting in a $20 million settlement for cardholders.
In re Discover Payment Protection Plan Marketing and Sales Practices Litigation, (N.D. Illinois.) where Mr. Schmierer served on the executive committee in challenging Discover’s imposition of charges for so-called “payment protection” or “credit protection” programs resulting in a $10.5 million settlement for cardholders.
From 2013 through 2017, Ross was selected by his peers as a New Jersey Super Lawyer, a prestigious recognition reserved for no more than 5% of lawyers in New Jersey. From 2014 through 2017, Ross was also awarded a lead counsel rating in the legal discipline of Consumer Protection.
Ross earned his J.D. from Brooklyn Law School, where he was an articles editor of the Brooklyn Law Review. While a member of the Brooklyn Law Review, he published a case comment entitled: An Attempt to Pick up the Fallen Bricks of the Wall Separating Church and State After Santa Fe v. Doe, 67 Brook. L. Rev. 1291 (2002). His comment was cited by several authors of subsequent law review articles, which included a law professor in the University of Pennsylvania Law School’s Journal of Constitutional Law. In addition, Ross was a member of the Moot Court Honor Society and was awarded the Best Brief Award in a National Constitutional Law competition.
Outside of his passion for helping consumers fight against corporate wrongdoing, Ross struggles with an addiction to golf. Ross grew up in Central Jersey and then lived in North Jersey for many years but has now planted his roots in South Jersey. Together with his wonderful wife, he looks forward to raising his son, Jakob, and daughter, Penelope, in Moorestown and more importantly, playing South Jersey’s many beautiful golf courses.
