Atlanta employment visa explained

How can I get an employment visa?

For instance, you can ask for an EB-1 visa if you are a member of a profession which requires at least a baccalaureate degree and have at least five years of professional experience.

Also, foreign nationals with exceptional abilities in science, arts, education, sports or business management can obtain an EB-1 visa

If you fall into this category, you can fill in a Petition for Alien Worker, also known as Form I-140. There are three distinct categories of foreign nationals that qualify for an EB-1 visa:

  • People with extraordinary abilities – This refers to performers, athletes, professors with an exceptional career, etc. You do not need a permanent job offer when applying for a visa, but you will be required to prove your abilities.
  • Outstanding professor or researcher (OPR) who is internationally recognized – For this type of EB-1 visa you will need to show you have been offered a permanent position with an American employer. Also, your employer will have to prove that they employ at least 3 other researchers. 
  • Multinational executive and managers (MEM) – This type of visa is available to executives or managers in multinational companies. You can apply for an EB-1 visa if the company is starting a US-based branch or if you are transferred to the US by a reputable company to work in its Georgia branch. The company supporting your application must show they have been doing business in the US for at least 1 year. 

What type of documents do I need for an EB-1 visa?

When you fill in your I-140 Form, you will also be required to provide professional credentials to prove you qualify for this type of visa.

For instance, you can supply academic records proving your degree status and your extraordinary abilities. Also, you can include documents showing you have experience in the referenced occupation. You can add pay slips showing you received a salary that demonstrates your outstanding abilities. If you are a member of a professional association, provide documents to show that. 

Prepare a list of your achievements in your chosen field, with supporting documents.
