Business lawsuit results in millions awarded to singer over breached endorsement deal

Nashville, TN – It is fairly common for businesses and individuals to get into disputes over money. However, when a formal agreement is breached and large amounts of money are at issue, these parties can end up in court for a breach of contract lawsuit. Depending on the specifics of the action, the breaching party can be made to pay various kinds of damages related to things like profits, wages, and other forms of compensation that are relevant to the agreement in question.

A recent business lawsuit involved a contract dispute over money owed to a well known singer from his endorsement of a beverage from 2014 to 2018 [1].

Singer wins millions after breached endorsement deal

The case was initially filed in 2021, but a verdict was not reached until January of 2023. According to the NBC news report, the singer Flo Rida argued that the company that owned Celsius energy drinks had breached a prior endorsement agreement and he was owed various forms of compensation, including stocks and royalties. The singer’s attorney argued during closing arguments for a value equivalent to one percent ownership of the brand, rather than a specific dollar value of damages.

At the conclusion of the lawsuit, the jury awarded the plaintiff approximately $82 worth of damages. They also found in the verdict that the defendant had engaged in fraud by hiding certain details from the plaintiff. The singer released a statement that he had renewed confidence in the judicial system after the result.

Deceptive tactics in contracts and agreements

Because the jury found that the defendant had used fraudulent tactics, it is likely that the damage award grew larger to deter such behavior. Businesses should not put language in any contract that is meant to mislead another party, lie to them, or omit important material facts. In a related manner, a business can also be found liable for misrepresentation if they do not intend to complete the terms of a contract as written. Any of these deceptive business practices can potentially result in legal action, especially in situations such as this where the wronged person lost substantial amounts of money.

A lawyer can provide more specific guidance to anyone who believes that they are involved in a problematic contract or similar deal.
