Two people died at Atlanta Medical Center after the vehicle they were in Friday night crashed through a retention pond metal fence by NCG Theaters in east Coweta County, barreled 100 feet down a slope and came to rest in the water. The occupants were identified as a 38-year-old woman from Grantville and a 40-year-old man from Grayson, who was driving the car, according to news reports.
Coweta Fire Rescue Battalion Commander Don Pickford on Saturday said the 2018 Infiniti Q50 drove through the parking lot heading northbound in the area immediately in front of the theater and continued on, crashing through the retention pond fence on the north side of the property and travelling down the 100-foot embankment and into the water. The two occupants were air-lifted to Atlanta Medical Center and later were pronounced dead, Pickford said. The cause of the crash is under investigation.
An investigation to determine the cause of the accident will need to be completed regarding insurance payments to cover wrongful death actions and death benefits on a driver’s policy. The importance of police reports and scene investigators will be heavily weighted toward compensation for these losses. Speak to a personal injury attorney, who can help with the collection of any pertinent documents needed to ensure a timely insurance recovery and the possibility of litigation.
Georgia is a Comparative Fault State allowing accident victims to seek damages up to 50% for partial responsibility. Wrongful death legal action must support a claim of negligence, where the victim was owed a duty of care, there was a breach in that duty, and the breach caused the injuries or loss. Motor vehicle accident victims and their families have the right to pursue compensation from insurance under Georgia law, and settlements may be impacted by reckless driving, drunk driving and vehicular homicide charges.
A wrongful death legal action is a particular type of lawsuit that is brought by loved ones of someone who dies because of the negligent, reckless, or deliberate act of someone else. Insurance settlements and court awards include damages to cover medical bills, burial expenses, lost wage compensation, pain and suffering and in some cases punitive damages may be awarded. A formal legal action may be initiated with the assistance of legal counsel, but must be undertaken in Georgia within two years from the date of the death caused by the accident.
