<b>Multiple locations did not keep proper records of overtime wages</b>

<span style=”font-weight: 400;”>The Mexican restaurant chain in question is called Chapala and the locations charged with violations are in Boise, McCall, Nampa, the Treasure Valley area, and Garden City. The violations are related to an investigation that showed unpaid overtime wages which amount to over $200,000. </span>

<span style=”font-weight: 400;”>A wage division director from the Department of Labor said that the chain systematically failed to pay overtime wages as required and keep accurate records. Other statements from the director seem to indicate that the restaurant intentionally attempted to circumvent labor regulations.  </span>

<span style=”font-weight: 400;”>The local news was able to contact the son of the owner of a location on Chinden Boulevard. He stated that the owner essentially paid all of the workers the same amount each week, regardless of how much they worked. He declined to comment further. </span>

<span style=”font-weight: 400;”>Some employees did not speak out earlier because this flat rate scheme would essentially give them the same pay, even if they did not work on a holiday or logged less hours at times. However, when their unpaid overtime was factored into their salaries, the workers would have still earned much more if the owner had followed the law properly. </span>

<span style=”font-weight: 400;”>The restaurant has since switched to an hourly pay system, and it seems that they will limit their workers to forty hours per week to avoid the possibility of having to pay overtime. They may also attempt to appeal the Department of Labor’s decision.  </span>

<b>Relevant overtime laws</b>

<span style=”font-weight: 400;”>As a general rule, workers in most fields must be paid at a higher rate for work in excess of forty hours per week. Some employers may choose to carefully log the hours of their workers and make sure they do not exceed this number to legally avoid paying overtime. However, if the employer only expects to pay a full time salary even while workers go beyond forty hours, they can get in trouble. In rare cases, an employer may even intentionally attempt to take shortcuts to avoid proper pay. This is both unethical and prohibited by labor and wage laws. </span>

<span style=”font-weight: 400;”>Workers who are affected by these illegal practices do have the power to take action and receive their unpaid wages as well as other remedies. </span>
