Ninth Circuit Court Strikes Down Trump’s Travel Ban, Again

The Ninth Circuit Court of Appeals ruled against the Trump Administration’s executive order banning immigrants from six Muslim countries from entering the U.S.

Akron, OH- The Ninth Circuit Court of Appeals dealt another blow to the Trump Administration’s travel ban, ruling against the ban. The decision is yet another strike against the President who made the ban one of his key campaign promises and one promise that he so far has been unable to deliver.

The three-judge panel of the Ninth Circuit Court deviated from the Fourth Circuit Court of Appeals which ruled against the travel ban on Constitutional grounds and ruled against the executive order on procedural grounds. Justices explained that the Administration failed to provide “sufficient justification” for banning people from six Muslim-majority countries. The panel noted that the President did not demonstrate that blocking the entry of an entire class of aliens would benefit the U.S and make residents more secure.

The panel of three justices wrote, according to CNN:

“We conclude that the President, in issuing the Executive Order, exceeded the scope of the authority delegated to him by Congress.” The panel added, “(I)mmigration, even for the President, is not a one-person show.”

The Ninth Circuit Court also cited Trump’s tweets in their decision, noting that he has repeatedly referred to the executive order as a travel ban. Although the Trump Administration insists in court documents that the executive order is in the interest of national security, the court pointed to the President’s tweets as proof that ban targeted a specific group. Justices said invoking national security cannot justify all executive actions.

The Trump Administration was unhappy with the court’s and asked the United States Supreme Court take up the case and issue a final ruling.

In a tweet following the ruling, the President said: “Well, as predicted, the 9th Circuit did it again – Ruled against the TRAVEL BAN at such a dangerous time in the history of our country. S.C.”
