Indians looking to come to Texas should know this

San Antonio, TX – Texas is a prime destination for Indian nationals looking to find a job and work in the United States. Unfortunately, since the Covid-19 pandemic started, getting a work visa or any type of US visa for that matter is next to impossible for Indians. Just to get an idea of how bad the situation is – if you’re in Mumbai you’ll have to wait until 2025 to get an appointment at the US consulate there. In New Delhi it’s even worse – the current wait time for an appointment is 833 calendar days.

The huge applications backlog the USCIS has to deal with affects all would-be immigrants. However, Indians are the hardest hit as they make up a large proportion of the recipients of H-1B and other work visas granted to skilled foreign workers, many in the tech industry.

Following a recent meeting with Indian foreign minister Subrahmanyam Jaishankar, US Secretary of State Anthony Blinken promised Washington will take steps to address the backlog of visas that has built up since March 2020. Blinken did not give any details of the plan, but said it would play out in the coming months.

This is good news for both Indian nationals currently in the US and those back in New Delhi or Mumbai waiting to come to America. If you’re an Indian hoping to get a job in Texas or a local company looking to hire skilled Indian workers, now would be a good time to contact an experienced immigration lawyer in San Antonio. An attorney can help you speed up the process by making sure you meet the requirements for an H1-B visa, have all the documents and your forms are error-free so the USCIS doesn’t reject or delay your application.

The applications backlog hurts US economy, not only Indian would-be immigrants

At present, there are about 4.2 million people of Indian origin in the US and even they have been hit by these delays. Those who are currently here on an employment visa do not dare to visit their families back in India because when they want to return to America they must get a new stamp from the US embassy in India and they face the same difficulties getting an appointment. For the same reason, they cannot afford the risk of a holiday anywhere outside US territory.

US companies are also affected by the huge backlog. Many IT companies in Texas rely on Indian techies and they cannot wait years to hire someone.

Inevitably, all these problems have a significant impact on the US economy. If they cannot bring highly skilled (and fairly cheap) workers to staff their US offices, important companies will eventually move their business to another country. Why struggle to bring the Indian IT experts you need to the US when it is much easier to move the office to New Delhi and hire the same people? Plus, wages in India are considerably lower so you don’t have to worry about paying your staff at least minimum US wage.

What are the conditions to get an H1-B visa?

You can apply for an H1-B visa if you want to work in what the USCIS defines as specialty occupations

You must prove to have:

  • Highly specialized theoretical and practical knowledge in a scientific domain
  • A bachelor’s or higher degree in the specific specialty (or its equivalent) is a minimum for entry into the occupation in the United States.

Keep in mind that an H1-B visa does not put you on a path to US citizenship. However, if you come to work in the US for three to six years on such a visa you may become eligible for a Green Card. You should seek counsel from a knowledgeable Texas immigration lawyer to see what your options are.

Also, if you manage to get an employment visa, you may be able to bring your spouse and your minor children to the US. They can apply for an H4 visa, but certain conditions apply so it’s best to have a reliable immigration lawyer help you with the paperwork.
