A Kentucky man was recently convicted of five counts of wanton murder after he allegedly caused a DUI accident on October 26ththat left a family of five dead. Daniel Edward Greis, 58, was said to have been driving more than 90 mph on Staffordsburg Road before he crashed into a vehicle carrying the Pollitt family, according to ABC 6 On Your Side. While police believed Greis was under the influence of alcohol and marijuana at the time of the fatal collision, his DUI defense attorney, Stacey Graus, argued otherwise.
While Graus did confirm that Greis “did smoke marijuana nine hours before the crash and that he did have a double bourbon a couple of hours before the incident while playing golf, neither of those impaired his driving.” Instead, Greis claimed another driver was responsible for him crashing into the family’s car. When Greis’ trial began back at the beginning of June, Graus argued that the cause of the accident was attributed to road rage. She said her client “was attempting to pass a car driven by Jamie Phillips on Staffordburg Road but couldn’t because Phillips sped up while Greis tried to pass.” And that is when the head-on collision occurred with the Pollitt’s vehicle.
After the jury deliberated for nearly four hours, they decided that Greis was guilty on all five counts of murder.
Graus went on to play the 911 call made by Phillips. The recording of the call to 911 went like this, “I had my daughter in the truck, I sped up because I didn’t want him to pass me. He tried passing me, I didn’t want him passing me because this road ain’t made for passing. I freaking sped up, I sped up.” Despite the evidence Graus provided to the court, by the end of the trial, the jury, after deliberating for four hours, found Greis guilty of five counts of murder for causing the accident that took the life of 27-year-old Samantha Malohn, 26-year-old Rodney Pollitt Jr. and their three children, 9-year-old Hailieann, 8-year-old Brenden and 6-year-old Cailie [Source: WKYT].
