Heart surgery is one of the most complicated types of surgeries that is performed. Both doctors and nurses must be careful and attentive when performing such a complex type of procedure to be sure they do it properly and don’t harm the patient who is undergoing the surgery. Unfortunately, mistakes are made during these types of procedures which leaves patients suffering from harsher conditions and even causes them to develop new ones. Apparently, that is what happened when a child underwent heart surgery at the Children’s Hospital in New Orleans.
According to the Louisiana Record, a mother in New Orleans filed a medical malpractice lawsuit on June 25thin the U.S. District Court for the Eastern District of Louisiana after her daughter became exposed to Nontuberculosis Mycobacteria (NTM). Magaly De La Cruz Gonzalez stated in the lawsuit that “Sorin Group Deutschland GMBH and Sorin Group USA Inc., which does business as Liva Nova PLC, were to blame for an allegedly faulty medical device that was used on her daughter during heart surgery.”
As a result of using the faulty Sorin Stockert 3T Heater-Cooler System, Gonzalez’s daughter, Genesis De La Cruz, became exposed to NTM. Gonzalez claimed that “Sorin had a responsibility as the designer, manufacturing, and marketer of the system, to make sure it was safe to use, but failed to meet that commitment.” In fact, back in 2015, the FDA issued a class II recall of the Sorin 3T System due to the “potential colonization of organisms, including Mycobacteria, in Sorin Heater Cooler Devices, if proper disinfection and maintenance is not performed per instructions for use,” the source pointed out.
After that recall was issued, Children’s Hospital sent out a notice in 2016 advising anyone who underwent a cardiac procedure that was performed with the Sorin 3T System may become ill. And Gonzalez’s lawsuit highlighted some of the reasons why the equipment was recalled. Apparently, the machine “has high injury and complication rates, fails to perform as intended, requires patients to undergo additional operations and has caused severe and sometimes irreversible injuries, conditions and damages to a significant number of patients.”
Sadly, Gonzalez’s daughter was subjected to having to undergo several other medical procedures, medical management, and had to take a course of antibiotic therapy. That antibiotic therapy led to her daughter suffering from adverse side effects, one of which could lead to the “possibility of future hearing loss.” And because of the negligence displayed by the parties named in the lawsuit, Gonzalez’s daughter had suffered from “physical pain, permanent scarring, and the inability to enjoy her life.”
