ABOUT Wells & Cuellar, P.C.

A boutique commercial and litigation firm that actively represents businesses, lenders, and creditors, while protecting their products, loans, and services.

The law firm of Wells & Cuellar, P.C., was established in 1987 in Houston, Texas, and has gained a statewide and nationwide reputation for excellence in the areas of debt collection, creditors' rights in bankruptcy, defense of consumer claims, and other commercial and civil litigation.

While our attorneys have solid credentials and decades of experience, we have excelled in our field and built a loyal client base over the years by adhering to the classic values of diligent legwork and ethical methods. We also stay current with the law, legal precedents and debtor defense strategies to apply our traditional approach to modern problems.

Our core clients include manufacturers, retailers, service companies, energy producers and traders, institutional lenders and a diverse range of businesses in Houston, Dallas, Austin, San Antonio, Beaumont, El Paso and throughout Texas. Our lawyers also represent national banks, trade groups and other corporate clients and creditors in bankruptcy proceedings, litigation, arbitration and appeals. We welcome the opportunity to consult or make special appearances for creditor representation in bankruptcy matters wherever we may be needed nationally.

Uniquely Qualified to Collect Debts and Defend Against Claims

Founder and president D. Brent Wells has practiced law in Texas since 1980. He is board certified in Commercial and Consumer Law by the Texas Board of Legal Specialization and, furthermore, is among the minority of consumer law attorneys who concentrate on the defense side rather than plaintiff claims. Brent is also nationally certified in Creditors' Rights Law by the American Board of Certification and is an experienced arbitrator and mediator.

James Cuellar is a Harvard Law graduate who clerked with the 5th U.S. Circuit Court of Appeals before embarking on an accomplished legal career in commercial litigation, creditor's rights and appellate law that has spanned more than 20 years. Jeffrey Stewart graduated with highest honors from Texas Tech with a degree in business management and then earned his J.D. from Texas Tech University Law School. Adam Swonke has an MBA from the University of Dallas and a legal degree from the University of Houston Law Center.

Our skilled attorneys have a strong foundation in business and intentionally overlap their areas of practice to function as a team in pursuit of clients' objectives. We believe we provide a competitive edge and exceptional value and service to our clients because of our talents, our focus, our structure and our philosophy:

-Cost-effectiveness - Wells & Cuellar provides a high level of service for a well-considered price. Attorneys with comparable experience to D. Brent Wells often charge much higher rates. We vary our rates depending on the size and complexity of the case.

-Responsiveness - Debts do not improve with age. We react as swiftly as we reasonably can, working quickly to attempt to recover monies. Inquiries are quickly channeled to an attorney who can take action, and we are accessible to clients by phone and e-mail so that they are never in the dark about the status of our efforts.

-Business savvy - It's bad business sense to throw more money down a hole chasing debts that are unlikely to be recovered. We help clients analyze the viability of claims and the costs versus benefits, and we strive to be revenue-positive for our clients rather than a cost center.

-Range, depth and flexibility - Our attorneys' experience ranges from two years to over 30 years. If your case requires a senior litigator's expertise, we can promptly engage with the firepower you need. When we can get the job done at lower billing rates, we pass those savings on to clients. Our range allows us to mix and match teams to hold our own against larger firms, while remaining sensitive to your bottom line.

Accomplished Texas Creditors' Rights Attorneys

We have practiced in the same areas of the law for decades. Brent began his commercial litigation practice over 30 years ago, and our firm was formed more than 24 years ago. Many of our creditor and institutional clients have given us the opportunity to represent them over an extended period of years, a testament to our service orientation and our long-term commitment to vigorously pursue the client's best interests through lawful means, including the Court system.
