ABOUT Allen A. Etish

Allen Etish is a litigator and advisor to individuals and businesses involved with disputes among shareholders, derivative actions and/or bankruptcy reorganizations. He has litigated various trials before juries and judges in the Chancery Division of the Superior Court of New Jersey, the Federal District Court of New Jersey and Pennsylvania, and the Bankruptcy Court in New Jersey and Pennsylvania. He has extensive experience in the following areas of law: (1) professional dissolutions and disputes, (2) Chapter 11 and Chapter 7 business bankruptcies, (3) redevelopment law, primarily representing groups of individuals who contest the eminent domain or condemnation process, and (4) general commercial litigation. Most recently, Mr. Etish represents a number of objectors to the redevelopment of Haddon Township in Camden County, New Jersey. Sandone v. Township of Haddon, 2008 WL 1787415 (N.J. Super. Ct., App. Div. 2008). Objections were raised to the determination that the area was "blighted" and other issues involving procedural deficiencies and the process utilized by the Township. The Township agreed to dismiss the pending litigation and begin the process again. Mr. Etish represented Wheaton Industries, a large glass and plastics manufacturer from Cumberland County, New Jersey, in a dispute involving shareholder's derivative rights before the Chancery Division of Gloucester County, the Appellate Division, and ultimately the Supreme Court. Wheaton, Inc. v. Smith, et. al., 146 N.J. 527 (1996). This dispute involved the valuation of a privately held corporation and the various offsets to fair value under the New Jersey Corporations Act. In addition, Mr. Etish has represented numerous creditors and debtors in bankruptcy cases, primarily in the District of New Jersey. Mr. Etish specializes in business Chapter 11 and Chapter 7 bankruptcies.
