Gary R. DeFilippo, Esq. is a former Assistant District Attorney. Since 2002 Gary has been a Trial Attorney practicing in the areas of Criminal Defense and Commercial Litigation (contracts) and Foreclosure Defense. As an Appellate Attorney Gary has been successful in overturning several criminal convictions. Of note, in People v. Timothy Turner 79 Misc.3d 473, 190 N.Y.S.3d 830 (Richmond Cty Sup. Ct. March 30, 2023) Gary argued and won a motion to overturn a 12 year prison sentence for Robbery based on New Evidence being discovered. Mr. Turner is now a free man awaiting the possibility of a new trial. This conviction was overturned at the trial court level, which in and of itself is extremely rare.

Gary is also President of Parole Preparation, in which using his experience as a criminal defense attorney he prepare inmates for their appearance before The New York State Parole Board by preparing a Parole Package which is intended to put the inmate in the best light possible when it is presented to the Board. This preparation also includes counseling the inmate on how to present him/herself to the Board when he/she appears for an interview.
Gary is admitted to practice before the Courts of the State of New York, since January 2001, the United States District Courts for the Eastern and Southern Districts of NY since April 2001, the United States Court of Appeals for the Second Circuit since April 2006 and the United States Supreme Court since June 2006.

Gary prepare each case for not just trial, but also in anticipation that the case may end up in an appellate court. Such preparation is necessary for the client to receive the most zealous representation whether the client prevails or not. Gary's philosophy is that there is no other way to represent a client to provide the best possible outcome in each and every case.

As an Assistant District Attorney in the Appeals Bureau,Gary wrote the winning Appellate brief in People v. Forbes, 283 A.D.2d 92, 728 N.Y.S.2d 64 (2nd Dep’t 2001) cert denied 97 N.Y.2d 681 738 N.Y.S.2d 296, 764 N.E.2d 400 (2001), a case which set precedents in New York on the issues of car stops and search and seizure.
