ABOUT Herbert Mondros

Herbert Mondros focuses his practice on commercial and corporate civil litigation, and criminal defense litigation in Delaware state and federal courts, including the Court of Chancery, the Superior Court and the United States District Court. He has experience prosecuting and defending all manner complex civil litigation including shareholders’ class and derivative actions, breach of fiduciary duty cases, preliminary injunctions, expedited corporate litigation, merger and acquisition litigation, claims under Directors and Officers insurance policies, demands to inspect corporate records under Section 220 of the Delaware General Corporation Law, commercial and contract disputes, employment and labor matters, claims against Homeowners and Community Associations, and complex tort cases. He has experience with identity theft and patent infringement.

Before joining Margolis Edelstein, Herb was a Trial Attorney with the Environmental Crimes Section of the Environment and Natural Resources Division of the United States Department of Justice, Chief Appellate Court Counsel for the United States Attorney for the Eastern District of Louisiana in New Orleans, and a litigation associate in the Delaware office of Skadden Arps.

Herb has successfully mediated disputes on behalf of boards of directors, construction companies, commercial landlords, and recently obtained a defense verdict at trial in a case against a home inspector involving claims moisture and mold intrusion, and summary judgment in favor of his clients in a lawsuit alleging fraud. Herb is also part of a defense team that secured the release of two Delaware men wrongfully convicted of capital murder who collectively spent more than 30 years on Delaware’s death row.
