Jeff Hamilton’s practice is concentrated in the areas of complex business litigation and bankruptcy litigation. Jeff believes in finding creative solutions for companies involved in litigation. He has significant experience with complex commercial litigation, including general business disputes, fraud and misrepresentation claims, breach of contract claims, lender liability, accounting malpractice and trade secrets. His experience includes acting as a court-appointed Special Master and as Counsel to receivers in actions brought by the Securities and Exchange Commission. He represents clients in a variety of industries, with a primary focus on banking, securities, real estate, transportation, and insurance.
Jeff also has significant experience with all aspects of bankruptcy proceedings, including commencing and defending bankruptcy claims, negotiating workouts and settlements, handling distressed properties and assets, and counseling distressed companies.
Prior to joining Jackson Walker, Jeff was a briefing attorney for United States District Judge Terry R. Means for two years.
PRACTICE EXPERIENCE
Served as counsel to financial institution in wrongful death case brought by family of armored car messenger who was killed in attempted armed robbery while he was servicing drive-through ATM at bank branch.
Served as counsel to the Trustee appointed, pursuant to the Securities Investor Protection Act, to liquidate a self-clearing broker dealer who held over $350 million in customer assets belonging to approximately 23,000 customers. Successfully closed and liquidated the business and processed customer claims. Successfully prosecuted dozens of avoidance actions and suits against third parties, including the principal bank and the auditors of the broker dealer.
Served as counsel to the court appointed Receiver in litigation brought by the Securities and Exchange Commission against multiple defendants operating a Ponzi scheme involving foreign currency trading. Successfully returned to defrauded investors more than 100% of their claims.
Served as counsel to secured lenders on $105 million credit facility in Delaware bankruptcy of oil and gas exploration company, including serving as trial counsel in adversary proceeding between lenders, debtors, and third party regarding priority of liens and value of collateral.
Served as counsel for secured lender on $20 million loan secured by raw industrial land in Dallas in cramdown litigation involving attempt by debtor to impose a lower interest rate and force lender to accept land in exchange for credit on the debt.
Represented a Pakistani consulting company in a major international arbitration case involving claims for fraud, misappropriation of trade secrets, and usurpation of business opportunities.
Negotiated a favorable settlement.
