ABOUT Lawrence A. Dany III

Larry Dany is lead partner of the Eversheds Sutherland (US) Construction Industry Practice Group in New York City. He helps clients across the construction industry resolve a wide variety of complex business and legal challenges through planning, contract negotiation and drafting, dispute avoidance, claim management, arbitration and litigation from inception through jury trial in state and federal courts across the country. Larry’s practice also focuses on occupational health and safety, and industrial and construction workplace incident response. When alleged violations arise, Larry guides internal investigations, prepares strategic responses to inquiries and defends entities in connection with investigations and enforcement actions brought by government agencies.

Larry is consistently recognized by leading publications as a “key name to note” (The Legal 500 United States 2016, 2017) and a “rising star” (Super Lawyers 2012-2017) in the area of construction law and litigation. He was honored as one of Engineering News-Record New York’s “Top 20 Under 40” (2016). Clients regularly commend Larry for his legal proficiency and manner with which he handles client matters. Represented a subsidiary of one of the world’s leading industrial and systems manufacturers, in a dispute with the New York City Department of Environmental Protection (DEP) concerning electrical work for a water filtration plant.
Represents a major multinational EPC contractor in a multimillion-dollar dispute with an electrical contractor concerning construction of an $875-plus million, 755-MW combined cycle plant in Maryland.
Represents a major multinational EPC contractor in disputes related to the $125 million expansion of an underground natural gas storage reservoir in Oregon.
Resolved a $20 million dispute between a major oil company and an EPC contractor concerning the construction of the critical riser pull-in system for a deepwater project platform.
Won an argument before the Appellate Division for the New York Supreme Court to vacate a $15 million judgment against an engineering, design and manufacturing company by one of the world’s largest real estate developers for claims sounding in a contract.
Represented a developer in resolving disputes with contractors concerning the delayed delivery of a 14-story, 389-unit multifamily and student housing project in Pittsburgh, Pennsylvania.
Represented a developer in successful mediation to recover damages for defective construction of an in-structure pool.
Won a jury trial and $14 million in damages for an engineering, design and manufacturing company in litigation against the company's former president for breach of contractual and fiduciary duties.
Represents a major multinational EPC contractor in connection with multimillion-dollar claims by a defaulted subcontractor for wrongful termination, acceleration and loss of productivity.
Represents an electrical contractor in more than $25 million in disputes with the New York City Department of Environmental Protection over biological nutrient removal process upgrade work performed at three separate wastewater treatment plants.
Represented the general contractor in $200 million in disputes regarding the environmental abatement and deconstruction of the last remaining building at Ground Zero.
Defended successfully a construction manager in a multimillion-dollar seizure action.
Attained a complete recovery for a large commercial tenant in a dispute with a commercial condominium owner concerning defective fireproofing.
Conducted an internal investigation of the German and Italian subsidiaries of a multinational medical device company for suspected FCPA violations.
Achieved a favorable result for six individuals in an SEC investigation regarding alleged insider trading.
Won early dismissal of five actions challenging a financial services provider’s loan product and alleging disclosure and unfair trade violations.
Obtained dismissal of claims against a pro bono client in connection with the planning, financing and renovation/construction of a low-income housing and community center.
Resolved favorably a trial brought against an associated person by the CFTC alleging 100-plus violations of the Commodity Exchange Act and seeking millions of dollars in restitution and a permanent bar from the industry.
Represents a construction manager in a dispute arising from the construction of a $75 million senior care facility and in a subsequent dispute following hurricane flooding at the facility.
Successfully represented buyer in M&A transaction in a contested $4 million claim against indemnity escrow fund.
