ABOUT Lino Mendiola III

Lino Mendiola advises clients on both litigation and transactional matters involving energy and regulatory law with a focus on the electric energy market. With more than 24 years of commercial and regulatory litigation experience, Lino represents utilities, private equity investors and other clients in state and federal court and before the Public Utility Commission of Texas and other state agencies, and advises on the regulatory aspects of complex energy transactions including infrastructure development, asset sales and joint ownership arrangements.

Lino frequently counsels clients on state and federal contracting and procurement law, and advises governments and businesses on procurement and contracting matters, such as DBE/HUB/MBE/WBE regulatory compliance, supplier diversity program development, and issues relating to diversity, inclusion and affirmative action. He is nationally recognized in designing, implementing and defending affirmative action programs and routinely offers legal advice in disputes involving procurement policies.

Lino serves on the Executive Committee of Eversheds Sutherland (US).

Selected Experience

Represented a private equity firm in connection with its acquisition of a residential gas distribution company.
Guided NRG Energy through DOE and NETL approvals for modifications to a cooperative agreement and provided regulatory advice related to the $1 billion Petra Nova Carbon Capture project, the world’s largest retrofit post-combustion carbon capture system.
