David M. Fothergill has been in practice since 2003, and is a partner with the firm.
He represents businesses, individuals, and insurance companies in complex litigation matters involving commercial disputes, products liability, intellectual property, catastrophic injury, toxic torts, property damage, construction defects, trucking and transportation, premises liability, inadequate security, licensing matters, breach of contract claims, and professional malpractice. Mr. Fothergill also regularly advises business on the legal implications of commercial contracts, warranties, leases, licenses, service agreements, employment agreements, and insurance agreements.
Mr. Fothergill is experienced in all aspects of litigation and appellate practice, and has tried cases throughout North Carolina. He is also versed in arbitration, handling commercial disputes pursuant to American Arbitration Association rules and procedures, as well as arbitrations involving uninsured/underinsured motorist insurance coverage. Mr. Fothergill negotiates and drafts commercial contracts and settlement agreements for a wide array of matters; and consults with his clients regarding non-litigation commercial matters, including contract and warranty compliance.
