Pennsylvania – March 23, 2021
A box truck driver suffered fatal injury after he lost control of his truck and crashed into a pole in the East End of Pittsburgh. The truck passenger managed to steer the truck out of the path of traffic when the driver lost consciousness, but ended up crashing into a pole. Paramedics from Murrysville responded to the scene where they found the driver slumped over the steering wheel of the Penske box truck. First responders had to use hydraulic tools to free him from the cab of the truck and he was taken to the hospital in critical conditioner where he later succumbed to his injuries. After fatal injury occurs, loved ones of victims should speak to an experienced accident attorney who can guide their actions toward damage recovery.
In Pennsylvania, family members, or legal representatives must file a wrongful death legal action to secure compensation when a loved one dies because of the negligent, reckless, or deliberate act of another. A Pennsylvania wrongful death attorney can assist with damages in these lawsuits that may include:
- Medical bills and treatment,
- Funeral and burial expenses,
- Lost wages compensation,
- Compensation for pain and suffering,
- Punitive damages base on individual case.
A personal injury attorney can be instrumental in claims processing with the insurer to cover immediate expenses to address funeral and burial costs. Further efforts toward damage compensation may be initiated in court, or through further insurance settlements.
An accident attorney can explain Pennsylvania’s “modified comparative negligence” rule, where an individual can still recover damages in a personal injury lawsuit, but the amount of compensation will be reduced by an amount that is equal to their percentage of fault. The state also has a “no-fault” component where victims can access payment from their own insurance companies to cover certain expenses related to the accident. An experienced accident attorney can answer most victim’s questions on the necessity of legal action toward financial recovery.
Hire legal counsel.
