There are millions of products on the market today that are available to consumers that carry a potential risk when using or consuming it. While these products may not be safe or could lead to a person developing a life-threatening disease, companies are still permitted to continue selling these products as long as they warn consumers of the dangers associated with the product as well as the conditions they could develop from using it. Unfortunately, not all companies do warn customers and many who bought and used certain products often find themselves dealing with unwanted medical conditions they didn’t know they would develop.
One example of this is the case involving 46-year-old Dewayne Johnson and the company Monsanto which manufactures a weed killer called Roundup [Source: National Public Radio]. When Johnson was just 42-year-old, he “developed a bad rash that was eventually diagnosed as Non-Hodgkin Lymphoma.” Non-Hodgkin Lymphoma “is a form of cancer that starts in white blood cells called lymphocytes, which are part of the body’s immune system,” according to the American Cancer Society.
After developing the cancer cells, Johnson, who is now “near death according to his doctors” believes the cancer started after he used Roundup. Johnson, who is a former school groundskeeper, claimed the company added a glyphosate-based herbicide in the weed killer that likely caused the disease. He decided to file a lawsuit against the company and hired a team of  CA personal injury attorneys to represent him throughout the duration of his case. After taking on the case, one of Johnson’s lawyers stated that the company “acted with malice and oppression” because they failed to warn consumers of the risk their product posed and “knew what they were doing was wrong and did it with reckless disregard for human life.”

After the case made it to the courtroom and in front of a jury in San Francisco, Johnson finally received the justice is was hoping to obtain.

On July 9th, after three days of deliberating, a jury awarded Johnson a total of $289 million in damages. He received $250 million in punitive damages and $39 million in compensatory damages. After the verdict was announced, one of Johnson’s lawyers said that it “should send a strong message to the boardroom of Monsanto.” Another attorney went on to say that the jury was finally able to see Monsanto’s secret after internal documents were revealed that showed the company knew for decades that the product could cause cancer. Monsanto is currently facing hundreds of other cancer-related lawsuits although they believe they aren’t liable for Johnson developing the cancer.
According to Scott Partridge, who is the Vice President of Monsanto, “Today’s decision does not change the fact that more than 800 scientific studies and reviews…support the fact that glyphosate does not cause cancer, and did not cause Mr. Johnson’s cancer.” He stated that the company was planning on appealing the decision and would “continue to vigorously defend this product, which has a 40-year history of safe use and continues to be a vital, effective, and safe tool for farmers and others.”
In most cases that involve an individual who has chosen to sue a company in California for an injury or illness they developed after using or consuming their product, the company generally denies the claims made against them as it could negatively impact their profits and their reputation. But, if you can prove that the company willingly withheld information that would help consumers become aware of the dangers associated with using the product, then the company should be held accountable for their error.
