You’ll Never Guess Why This New Yorker is Suing BMW

People may file product liability claims for a variety of reasons, but almost all of these claims involve some type of injury. Woman Sues BMW for Thumb Injury

This lawsuit began all the way back in 2018, when a Long Island woman claimed that her BMW almost cut off her thumb due to a faulty automatic door mechanism (1). Although her thumb wasn’t actually severed, it was reportedly “crushed” to the point where she can no longer participate in various activities, such as gripping a pen or engaging in intimate relations with her husband. One doctor said it was the worst bone-crushing injury he had ever seen. This individual isn’t the only person who has been harmed by BMW’s automatic doors, and the company has faced similar lawsuits in the past.

The Lawsuit is Heating Up

On March 29th of 2022, it was reported that the lawsuit was going to trial (2). However, the federal judge in charge of the case in New York reprimanded both the defendant and the plaintiff for “frantic, shameless efforts to obtain tactical advantage.” Both sides had submitted a considerable number of filings just before the trial. Apparently, the US District Court for the Eastern District of New York was hit by 60 additional docket entries, going far beyond what is normally seen before a trial. The judge later encouraged counsel to meet in person and resolve their difference so the trial could move ahead without what he called “senseless objections.”
